Anger cannot fully express what I am feeling about this case right now. Since I am struggling for words, I will keep it brief. A judge in Montana, Todd Baugh, issued a 30 day jail sentence to Dean Rambold, a ex teacher who admittedly raped a 14 year old female student multiple times. As the case went to court, the young lady, unfortunately committed suicide.
The jail sentence is not the most shocking result of this situation, it is the comments from the judge. Baugh reportedly told the court “that the victim was “older than her chronological age” and “as much control of the situation” as the teacher, according to the Billings Gazette.” He also stated “Obviously, a 14-year-old can’t consent. I think that people have in mind that this was some violent, forcible, horrible rape,” Baugh told the newspaper. “It was horrible enough as it is just given her age, but it wasn’t this forcible beat-up rape.”
Later, meaning a few hours ago, the judge told the same publication, “in a letter to the editor to the paper, the Gazette reported, in which he wrote he was “not sure just what I was attempting to say, but it did not come out correct. What I said is demeaning of all women, not what I believe and irrelevant to the sentencing,” Baugh wrote. “My apologies to all my fellow citizens.”
But he still stands by his ruling for the case. Which leads me to believe that this judge is full of crap. He sentenced this man based upon his personal feelings-that is evident. The only reason he is attempting to refute his words is because of the many petitions going around asking for his resignation.
And that is why I’m writing this post. MoveOn.org has created a petition asking for the resignation of Judge Baugh, and I agree that he needs to step down. Court cases in this country set presidents for other cases. We cannot afford to have sex offenders getting short term or suspended jail sentences because judges like Baugh believe that victims are just as much to blame as the offender.
Especially when it comes to children. If we as a people, as a Nation, as a SPECIES cannot protect our children then what good are we? I look at our youth and my heart aches. We have failed them in so many ways; we can’t continue to let them down any further.

According to the Billings Gazette, Judge Baugh argued that the 14-year-old victim of rape in this case was “older than her chronological age” and “as much in control of the situation” as her 49-year-old rapist. In doing so, Baugh places the responsibility for the situation on a troubled child — one who committed suicide just two years later — and excuses the criminal actions of an adult who violated the ethical standards and trust of his community. Baugh has engaged in the worst kind of victim shaming, while increasing the possibility that more child predators, relying on the laxity of a judge who more readily sympathizes with the abuser than the abused, will prey on other children in the future. For the safety of our community, and the sake of sexual abuse victims whose confidence Baugh has lost, we ask that he resign from his public position as district court judge.

My heart goes out to the family of 14 year old Cherice Moralez. I can’t imagine what horror her mother went through in that court room as that sentence was handed down. To have the life of your baby (no matter how old they get, they are always your baby!) devalued is unimaginable. Let’s show Cherice and her family that she does matter, that her life on this earth was more valuable than 30 days, and that the lives of all our children around the world are priceless.
